Terms and Conditions for MyFamily Grocer Loyalty Program
M5 Capital Trading Ltd trading under the business name MyFamily Grocer (the “Company”), is a private limited company incorporated under the laws of Mauritius.
1. Introduction
1.1. Welcome to the MyFamily Grocer Loyalty Program (“Loyalty Program”). With just a scan, you can access benefit/s, and win prize/s.
1.2. By registering in the Loyalty Program, you acknowledge that:
a) you have read, understood, and accepted the Terms and Conditions (“Terms and Conditions”) herein incorporated in this document; and
b) you have provided consent for the collection of Personal Data (“Personal Data”) for the purpose of administering the Loyalty Program.
2. Definitions
2.1. “Member/s” means a natural person who has registered for the Loyalty Program.
2.2. “Eligible Purchases” means purchases made at MyFamily Grocer which are eligible to earn rewards under the Loyalty Program, and excludes any products and/or transactions which the Company may determine, from time to time and at its sole discretion, to be excluded from the Loyalty Program, including but not limited to tobacco products and/or promotional products and/or price controlled products.
2.3. “Rewards” means the units earned by Members through Eligible Purchases, which may be redeemed for discount and/or prizes.
2.4. “Loyalty Card” means an electronic card issued by the Company through its SMS portal and linked to the Member’s registered local mobile telephone number, on which the Member’s loyalty rewards transactions are recorded.
3. Eligibility of Participant/s
3.1. The Loyalty Program is open to natural persons who are customers of MyFamily Grocer, and that meet the following criteria:
a) Are aged 18 years and over;
b) Reside in Mauritius and hold a valid National Identity Card (“NIC”) or Residence Permit for work or otherwise.
4. Commercial Use Restrictions
4.1. The Loyalty Program is not open to Corporate Entities and shall not apply to any purchases made for commercial purposes, including purchases made for resale, bulk trading, or for the benefit of any business or entrepreneurial activity.
4.2. Redemption of prizes under the Loyalty Program shall be strictly limited to purchases made by an individual for personal and domestic consumption only and shall not apply to any purchases made directly or indirectly for business or commercial purposes, including resale or for the benefit of any entrepreneurial activity.
4.3. The Company reserves the right to decline any redemption of prizes made in relation to purchases which, in the Company’s sole discretion, are deemed to have been made directly or indirectly for business or commercial purposes, including resale, bulk purchasing, or for the benefit of any entrepreneurial activity.
5. Application for Loyalty Card
5.1. Application for a Loyalty Card can be made either at a MyFamily Grocer Store or on the MyFamilyGrocer.mu Website (“Website”).
5.2. The application will require the applicant's first name, family name, NIC number (Mauritian Citizen) or passport number and Non-Citizen Identification Number (Foreign Resident), city of residence, email address, and a mobile number registered in Mauritius (collectively referred to as “Registration Information”).
5.3. All Registration Information provided must be true and accurate.
5.4. Applicants must acknowledge that they have read and understood the Terms and Conditions to complete the registration process.
5.5. After a successful online registration, Member/s will receive their Loyalty Card on their mobile phone via an SMS. Member loyalty cards should be presented at the checkout counter/s upon each purchase thereafter, at a MyFamily Grocer store.
5.6. Member/s are responsible for promptly notifying the Company of any changes to their Registration Information by contacting the Customer Service Team at +230 4662615, Monday to Friday from 8 AM to 5 PM (“Customer Service”).
6. Loyalty Card
6.1. The Loyalty Card remains the property of the Company, and the Company reserves the right to issue, reissue, or withdraw any Loyalty Card at any time.
6.2. The Loyalty Card is non-transferable.
6.3. In the event of inaccessibility to your Loyalty Card due to theft, loss, or damage, Member/s must either visit the nearest MyFamily Grocer store or contact the Customer Service to temporarily ‘freeze’ the card.
6.4. If you require an additional Loyalty Card for reasons such as loss or theft, the Company may charge a fee of Rs. 100 (Rupee One Hundred) for each additional Loyalty Card issued.
6.5. The Company reserves the right to update or change the Terms and Conditions at any time without prior notice. Member/s are advised to regularly verify the latest version of the Terms and Conditions, which shall be available on the Company website.
7. Termination of Membership
7.1. The Company reserves the right to terminate any membership under the following conditions:
a) A Member has not earned or redeemed Rewards in the past 12 consecutive months;
b) A Member has passed away;
c) The Company has reasonable grounds to believe that a Member has committed fraud or misconduct;
d) The Loyalty Program is terminated.
7.2. Member/s may terminate their membership at any time by contacting Customer Service. This will result in the cancellation of any accumulated Rewards.
7.3. Upon termination, the Loyalty Card must be deleted at the Member’s own cost.
8. Rewards
8.1. Member/s earn Rewards on each purchase by presenting the Loyalty Card at any MyFamily Grocer checkout counter. Rewards are awarded as follows:
a) 1(One) percent on Eligible Purchases made at any MyFamily Grocer store.
8.2. Opportunities to earn extra Rewards may be offered on various product/s and promotional activities for limited periods of time and solely at the Company’s discretion. In such event, the Company reserves the right, at any time, to impose purchase limits on any product for the purpose of earning a specific amount of Rewards.
8.3. Member/s are encouraged to monitor their Rewards transactions to ensure accuracy.
8.4. Rewards credited in error or related to cancelled purchases may be deducted at the Company’s discretion.
9. Redeeming Rewards
9.1. Rewards can be redeemed in the form of:
a) A discount on any purchases within a Myfamily Grocer Store or
b) A gift option available from time to time within a MyFamily Grocer Store.
9.2. Rewards cannot be exchanged for cash.
9.3. Rewards are non-transferable.
9.4. Member/s will be required to present their National Identity Card (Mauritian Citizen) or Passport (Foreign Resident) when redeeming Rewards for verification purposes.
9.5. Gifts presented as options at Myfamily Grocer are solely at the discretion of the Company and are not exchangeable, refundable or transferable.
9.6. The Company reserves the right to change the conversion percentage of the Rewards without prior notice.
10. Return Policy for Purchases
10.1. For returned items purchased through redeemed accumulated Rewards, the Company may, upon verification and acceptance of the returned items, refund the Member/s the equivalent Rewards to their Loyalty Card.
10.2. For returned products on which the Member/s earned Rewards, the Company reserves the right to deduct any Rewards earned from the purchase of the returned products, upon verification and acceptance of the returned product.
11. Data Usage
11.1. All registrations are subject to our privacy policy, which may be amended from time to time.
12. Limitation of Liability
12.1. The Company shall not be held liable for the loss or theft of the Loyalty Card, nor for any unauthorised use or fraudulent activities.
12.2. The Company shall not be held liable for any direct, indirect, incidental, special, or consequential damages arising from participation in the Program.
12.3. By participating in the Program, Member/s waive any right to bring claims against the Company arising out of or in connection with the Loyalty Program.
